Shifts in the legal regulation of microplastics management and the influence of a possible international plastics treaty
Original title: Posuny v oblasti právní úpravy nakládání s mikroplasty a vliv případné mezinárodní úmluvy o plastech
AI summary Read the abstract
The EU has passed new rules to limit microplastic pollution from plastic pellets, packaging, and waste shipments, building on earlier regulations. However, global treaty talks aimed at cutting plastic production, the real source of microplastics ending up in our food, water, and bodies, have stalled due to disagreements among countries. Without binding limits on plastic production, experts say the treaty won't do much to strengthen protections already in place.
This article examines the recent developments in the EU’s regulatory framework on microplastics and provides an analysis of the ongoing negotiations concerning an international treaty on plastic pollution. The article builds on the adoption of the Microplastics Regulation (2023/2055) and maps subsequent EU legislative steps in this area, in particular the new Pellets Regulation (2025/2365), the Packaging Regulation (2025/40), and the Waste Shipment Regulation (2024/1157). In the second part, the author evaluates the evolution of the draft texts of the future international treaty – from the ambitious and stringent Zero Draft to the compromise-oriented and recommendatory Chair’s Draft Text Proposal of 2025. The article analyses the causes of the diplomatic stalemate, especially the dispute over the inclusion of so‑called upstream measures that would limit the production of primary polymers. In conclusion, the author assesses the potential impact of the international agreement on EU law and notes that without firmly established production limits, the treaty’s influence on EU legislation will remain rather marginal.

Challenges for Regulation and Management of Microplastic in Environment and Proposed Changes
AI summary Read the abstract
This review examines failures in international law and national regulations to adequately address microplastic pollution in water bodies, arguing that recent treaty negotiations have been insufficient and proposing regulatory changes to better manage microplastics in the environment.
From micro to macro: legal tools for combating plastic pollution at national, EU, and international levels
AI summary Read the abstract
Researchers analyzed how laws at the national, European Union, and international levels have evolved to address microplastic pollution, tracing the shift from voluntary guidelines to binding rules like the EU's 2023 restriction on synthetic microparticles. The review identifies ongoing challenges — including inconsistent definitions and weak enforcement — and calls for stronger global governance to close the legal gaps.
From fragmentation to coherence. The UN plastics treaty as the law's response to the environmental crisis
AI summary Read the abstract
Plastic pollution is a growing global health and environmental crisis, and countries are now negotiating a UN treaty to tackle it together. This paper reviews that negotiation process, comparing it to existing environmental laws to identify gaps, and explains what the treaty could mean for regulations in the EU and Poland. Stronger, more coordinated plastic laws could ultimately mean less plastic and microplastic exposure in our food, water, and bodies.
Advancing the international regulation of plastic pollution beyond the United Nations Environment Assembly resolution on marine litter and microplastics
AI summary Read the abstract
This legal paper reviews international frameworks relevant to plastic pollution and argues for a binding global agreement specifically targeting plastic pollution, beyond existing resolutions. A comprehensive international treaty is increasingly seen as necessary to meaningfully reduce plastic pollution, including microplastics.
